  1. This Privacy Policy sets out the rules for the processing and protection of personal data provided by users in connection with their use of the services offered by the EXCLUSIVE Aparthotel website (hereinafter: the Website).
  2. The administrator of personal data contained on the Website is EXCLUSIVE APARTHOTEL SP. z o. o., Wrocław 50-148, ul. Krawiecka 6 ap.4, entered into the register of entrepreneurs with the TAX number: PL8971880166 (hereinafter: PDA).
  3. In case of questions, comments or reservations regarding the processing of personal data, the User may contact the Administrator in accordance with the data provided on the website.
  4. This document is an expression of concern for the rights of people using the website as well as an expression of the Exclusive Aparthotel’s compliance with the principles of personal data protection and diligence in guaranteeing the security of Users' personal data along with information regarding online activity, in particular, the User's ability to exercise their rights in connection with the GDPR (General Data Protection Regulation)

In order to ensure the security of the entrusted personal data, the PDA operates based on internal procedures and recommendations, in accordance with the relevant legal acts regarding the protection of personal data, and in particular in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 EC (hereinafter: GDPR).
  6. The PDA takes special care to protect the interests of data subjects, and in particular ensures that personal data are: a. processed in accordance with the law, b. collected for specified, lawful purposes and not subjected to further processing inconsistent with these purposes, c. substantively correct and adequate in relation to the purposes for which they are processed, d. stored in a way enabling identification of data subjects for no longer than necessary to achieve the purpose of processing.
  7. PDA processes data for the following purposes:
    1. marketing, including sending commercial information to an e-mail address, if the Customer has consented to it, by checking the appropriate box in the reservation process or in connection with subscribing to the Newsletter pursuant to Art. 6 section 1 letter a GDPR.
    2. performance of the contract or taking action at the request of the data subject before concluding the contract, including the provision of services provided by the controller pursuant to Art. 6 section 1 letter b GDPR,
    3. accepting a reservation using the online reservation system pursuant to Art. 6 section 1 letter b GDPR,
    4. keeping records and fulfilling legal obligations imposed on the Administrator pursuant to Art. 6 section 1 letter c GDPR,
    5. pursuing the legitimate interest of the PDA in special cases, e.g. handling complaints, debt collection, pursuant to Art. 6 section 1 letter f GDPR,
    6. responding to user inquiries submitted using the contact form or sent in a message sent directly to the e-mail address provided on the website, pursuant to Art. 6 section 1 letter f GDPR
  8. The scope of data processed varies depending on the purpose referred to in point 7. However, as a rule, PDA processes data such as:
    1. name and surname,
    2. e-mail address,
    3. telephone number,
    4. invoice data (Tax Identification Number, address, company name).
  9. PDA stores personal data that the User provides for as long as necessary to achieve the purpose for which they were provided, or to the extent necessary for the Exclusive Aparthotel to protect its rights or in accordance with applicable regulations. Personal data collected on the basis of consent will be stored until the consent is withdrawn or until the purpose of processing ceases. The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal. Accounting data will be processed for a full five years from the date of issue.
  10. To use the Newsletter function of the Website, the User will have to register. Receiving the Newsletter requires providing only an e-mail address. The Newsletter module on the home page www.eahotels.pl is intended for this purpose. By providing your e-mail address, the User consents to the processing of his or her personal data. The collected data is used to send content within the Newsletter. The Newsletter subscriber has the option to unsubscribe from receiving it at any time.
  11. Consent to the processing of data for marketing purposes and sending commercial information, including receiving the Newsletter, is voluntary and may be withdrawn at any time. Withdrawal of consent requires clicking the appropriate link in the received message or sending such a notification to the PDA's e-mail address. Withdrawal of consent does not affect the legality of activities carried out before its withdrawal. In case of technology, withdrawing consent involves changing cookie settings.
  12. The user is informed upon the first visit to the EXCLUSIVE Aparthotel website about the use of cookies. By remaining on the website, the user accepts the use of cookies on the website. If the user does not change the browser settings, he or she consents to the use of cookies.
  13. The cookie settings will be changed after restarting or refreshing the session on the PDA website.
  14. The installation of "cookies necessary for the basic functionality of the Website" is necessary for its proper operation, in particular required for authorization.
  15. Cookies necessary for the operation of the website can be changed by changing your browser settings. Changing the settings may result in the website malfunction.

  17. Users who, after reading the information available on the Website, do not want cookies to remain saved in the device's web browser, should delete them from their browser after completing their visit to the Website. The following types of cookies are used on the Website:

Some cookies may be placed by the Online Reservation System provider only for the purpose of: a. improving and supporting the booking process, b. analyzing and collecting statistical data regarding the use of the website and online booking system in order to improve them, c. the provider of the Online Reservation System informs about installed cookies in the user interface of this system
  21. PDA may use automated decision-making, including profiling, for marketing purposes (including automated matching of advertisements to User interests and measuring their effectiveness), and adapting the offer pursuant to Art. 6 section 1 letter a GDPR.
  22. The recipients of personal data may be bodies, institutions and entities authorized under the law, as well as entities providing services to the PDC (e.g. legal, IT, marketing, accounting services and other entities participating in the implementation of the ordered service.

  24. The data processed by the ADO may be viewed by the Website user who provided it. The user also has the right to:
    1. access to User data,
    2. rectification (modification) of data,
    3. deleting data (right to be forgotten) and limiting or ceasing the processing of User personal data at any time,
    4. object to processing,
    5. data transfer,
    6. submit a complaint to the supervisory body - the President of the Personal Data Protection Office with its registered office at ul. Stawki 2 in Warsaw.

  26. The Website may contain links to other websites that operate independently of the Website and are not supervised by the Website in any way. These websites may have their own privacy policies and regulations. It is recommended that user read them carefully.
  27. Security of shared data. The Administrator ensures that the User's data is treated with care and taking into account the obligations arising from applicable provisions on the protection of personal data. PDA takes care of and protects the website against unauthorized access by third parties and controls the methods of collecting, storing and processing information.
  28. Data processing is carried out in accordance with organizational procedures and methods strictly related to the indicated purposes. To ensure the security of data entrusted to the Company, internal procedures and recommendations have been developed.PDA reserves the right to change the privacy policy of the website, which may be caused by the development of Internet technology, possible changes in the law regarding the protection of personal data, and the development of the Website. User will be informed of any changes in a visible and understandable way.
