These rules and regulations must be followed by Guests staying in all aparthotels of EXCUSIVE Aparthotel Sp. z o.o.

1. Check in/check out

  1. Check in time is 2 p.m. and check out time is 11 a.m.
  2. Guests can get early check in or late check out subject to availability, only with the prior consent of the EXCLUSIVE Aparthotel reception. Late check out is subject to an additional charge:
    a. Check out by 3 p.m. is subject to an additional fee of 50% of the current nightly rate.
    b. Check out after 3 p.m. is subject to an additional fee of 100% of the current nightly rate.

2. Rules of hotel stay

  1. Guests will be charged in advance for the whole stay.
  2. Guests shall abide by the principle of good neighbourly relations and the Aparthotel policy and house rules at all times throughout the whole stay.
  3. This aparthotel has "Quiet Time" between the hours of 10pm and 7am. In the case of a disruptive Guest, who may be reported by other Guests, staff, building administration, public official and other law enforcement officers, such a disruptive guest will be charged by EXCLUSIVE Aparthotel a fine in the amount of PLN 1,000 (one thousand Polish zlotys).
  4. It is strictly forbidden to host any parties, loud meetings and conduct business involving customer service and visits. If a Guest fails to comply with this provision or the EXCLUSIVE Aparthotel team consider his or her behaviour to be rude, disruptive and/or violating this Aparthotel policy and house rules, EXCLUSIVE Aparthotel reserves the right to terminate the accommodation of such a Guest and to call the police. In this case EXCLUSIVE Aparthotel shall not be liable for any claim to refund the lost accommodation or any damage resulting from termination of accommodation.
  5. The number of people staying in the apartment cannot exceed the limit stated in the registration card. If this limit is exceeded, EXCLUSIVE Aparthotel reserves the right to charge a fee for each extra person. Such a person/persons may be asked to leave the premises immediately if the maximum capacity of the apartment has been exceeded. Subletting or making the apartment available for use by a third party on a different legal or factual basis is forbidden.
  6. Only persons of 18 years old or older are permitted to rent an apartment. Minors are allowed to stay in the apartment only when supervised by an authorised adult guardian.
  7. Guests are required to use the apartments and common areas for their intended purpose and to maintain them in the same condition as found upon arrival. No alterations, improvements and modifications to the apartments and to their equipment and furnishings are allowed.
  8. No devices that may pose a direct fire hazard, such as electric water heaters, fan heaters or gas burners are allowed in the apartment. Such devices may be used only with the written consent of EXCLUSIVE Aparthotel. Explosives, flammable materials or materials with an unacceptable intensive odour are strictly prohibited.
  9. Each Guest shall be obliged to report to the EXCLUSIVE Aparthotel staff on any irregularities and reservations regarding quality.
  10. Any unwanted or disturbing conduct of other residents or people in the building should be reported immediately to the EXCLUSIVE Aparthotel staff.

3. No smoking

  1. Smoking and electronic cigarettes are strictly forbidden in the apartment and in the common areas of the building. Should Guests fail to comply with our non smoking policy, they will be charged a fine of PLN 500 (five hundred zlotys) for every breach of this provision.

4. Responsibility for the apartment

  1. In the event of damage to the apartment or common areas of the building, Guests shall be obliged to pay compensation which fully covers the value of the losses suffered. Any observed defects should be reported to the reception upon arrival. If no defects have been reported, it is assumed that here are no objections to the condition of the apartment.
  2. When leaving the apartment, Guests are required to close all windows and lock the premises with all the locks for which they hold the keys.
  3. Guests are responsible for the actions of any third parties staying in the apartment but not listed on the registration card as well as for their own actions and omissions.
  4. Guests, by accepting these regulations at the check-in, agree to hotel employees collecting a damage deposit in the amount of PLN 500 (five hundred zlotys) in the form of pre-authorisation on their payment card or in cash.
  5. If damage to the apartment was noticed, pre-authorisation or cash deposit will be used as compensation for the damage. Depending on the amount of damage, EXCLUSIVE Aparthotel may return the unused part of the deposit or claim supplementary compensation on general terms.

5. Children in EXCLUSIVE Aparthotel

  1. Children under 3 years old stay free of charge when sharing bedding available in the apartment.
  2. A baby cot with bedding may be provided upon request for an additional charge in line with the applicable price list.
  3. Children must be under the constant care and supervision of an adult throughout their stay in the building. The legal guardians are responsible for the children’s behaviour, including any damage caused.

6. Pets

  1. EXCLUSIVE Aparthotel is pet friendly. However, their stay will be charged additionally in line with the applicable price list.
  2. Any damages caused by the pet will be financially covered by its guardian.

7. Force majeure, exceptional situations

  1. If unforeseeable circumstances occur and their results cannot be immediately prevented or fixed by standard means, EXCLUSIVE Aparthotel reserves the right to offer the Guest alternative accommodation of a standard similar to the originally booked accommodation.
  2. EXCLUSIVE Aparthotel has the right, in the event of force majeure, as well as in case of other special circumstances beyond the control of EXCLUSIVE Aparthotel, to withdraw from the agreement with the Guests and shall notify the guests immediately, and, if possible, at least 24 hours in advance of their scheduled arrival.
  3. This also applies to cases where the personal safety of the Guests or their property cannot be guaranteed for reasons beyond the control of EXCLUSIVE Aparthotel. The amounts paid by the Guest less amounts due for services already rendered will be returned immediately.

8. Check out

  1. Keys to the apartment and garage remote controls should be returned to the reception of EXCLUSIVE Aparthotel by 11:00 a.m.
  2. If the keys to the apartment are lost, Guests are required to pay a fee of PLN 300 (three hundred zlotys).
  3. If a magnetic card or chip is lost, Guests are required to pay a fee of PLN 100 (one hundred zlotys) for each lost or damaged item.
  4. If a garage remote control is lost, Guests are required to pay a fee of PLN 150 (one hundred fifty zlotys).

9. Personal data

  1. The data controller of the Guests' personal data is Exclusive Aparthotel Sp. z o.o. with its registered office in Wrocław at ul. Krawiecka 6/4, 50-148 Wrocław, Poland. Guests' personal data is processed in order to enable booking, providing services and collecting payment for those services. The legal basis for the processing of guests' data is Art. 6.1 b and Art. 6.1 f of the GDPR.
  2. The processed data are name, surname, address, date of birth, number of the document confirming identity, telephone number or e-mail address.
  3. When checking in the Guests are obliged to present documents confirming their identity.
  4. With the express consent of the Guests, their personal data will be processed by EXCLUSIVE Aparthotel Sp. z o.o. for the purposes of direct marketing of its own products and services as well as sending commercial information by means of electronic communication, to the e-mail address and telephone number provided by the Guests. The legal basis for the processing of Guests' data is Art. 6.1 a of the GDPR.
  5. Each consent is voluntary and may be revoked at any time by sending information to the e-mail address mojedane@eahotels.pl. Revoking consent will not affect the right to process Guests' personal data while the relevant consents where in effect.
  6. The Guests' personal data will be kept for the duration of the agreement and no longer than 6 years after its termination. In order to fulfil the legal obligation incumbent on the controller, the data will be kept for a period required by applicable law. Data such as name and surname, e-mail address and telephone number processed for the purposes of direct marketing will be kept until the Guest raises an objection to their processing.
  7. Guests have the right to access their data and the right to rectify, erase, restrict data processing, as well as the right to data portability, the right to object, the right to withdraw consent at any time.
  8. Guests have the right to lodge a complaint with the supervisory body when they consider that the processing of their personal data violates the provisions of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
  9. Personal data submitted by Guests to EXCLUSIVE Aparthotel Sp. z o.o. will be made available only to persons authorised by EXCLUSIVE Aparthotel Sp. z o.o., i.e. to employees/partners for whom access to such data is essential in performing their duties and to entities processing data on behalf of EXCLUSIVE Aparthotel Sp. z o.o.
  10. Guests' data will not be transferred outside the European Economic Area, i.e. to third countries.

10. Guests' belongings in the apartment

  1. EXCLUSIVE Aparthotel is liable for the Guests' belongings during their stay in the apartment only on the terms set out in Art. 846 of the Polish Civil Code.
  2. Personal belongings left by the Guests in the apartment after their departure will be sent upon request and at their expense to the address indicated by the Guests. If such a request is not expressed, the hotel will store the above-mentioned belongings for three months, and after this period, they will be disposed of. Foodstuffs and medicines will be disposed of immediately after Guests' departure due to their particular nature.

11. Dispute settlement

  1. Any disputes between guests and EXCLUSIVE Aparthotel sp. z o.o. shall be settled by the court competent for the registered office of EXCLUSIVE Aparthotel Sp. z o.o. Where the guest is a consumer, they will be settled on a general basis. All matters not covered shall be governed by the Polish Act of 23 of April 1964 Civil Code (Journal of Laws 2017, item 459).
